Updates to the MSBA's Designer Contracts and Associated Documents
Please be advised that the Massachusetts School Building Authority (“MSBA”) has updated several designer template documents including:
- Designer Services Base Contract for Design/Bid/Build and CM at Risk
- Designer Contract Amendment - Construction Manager at Risk (“CMR”)
- Designer Contract Amendment – Design, Bid, Build (“DBB”)
- Designer Request for Services (“RFS”)
- Designer Selection Procedures
- Designer Services Base Contract Pages 1-2 and Attachments A, C, D, E and F
The updated contracts and documents, (v. February 2025(1)) are available on the MSBA’s website and can be found on the Designer Selection Process page (under “Module 2- Forming the Project Team” under “Building With Us”)
Updates include reorganization & clarification of the scope of work to be considered “Basic Services” (Article 7), "Extra Services" (Article 8) and "Reimbursable Expenses" (Article 9). Also included is clarification about the formatting of cost estimates and project manuals to bring them into alignment with the DD/CD review templates for each submittal phase. References to NE-CHPS and LEED-S have also been updated. The documents include updated requirements for the Municipal Construction Affirmative Marketing Program. (See: Project Advisory 90).
All MSBA Core Program projects that have not yet executed these documents for their project must use these updated designer contracts and associated documents.
